GENERAL TERMS AND CONDITIONS OF SALE
Instant Outdoor

  1. Scope of application
    These General Terms and Conditions of Sale (hereinafter “GTC”) apply to all product sales concluded between Instant Outdoor (hereinafter “the Seller”) and any individual or legal entity (hereinafter “the Customer”), carried out in-store.
    Any order implies full and unconditional acceptance of these GTC.
  2. Products
    Instant Outdoor offers for sale and rental, in particular, the following products:
  • sports equipment (foil, wingfoil, kite, bicycle and related equipment),
  • sportswear and accessories,
  • eyewear,
  • various accessories,
  • food products: drinks, ice cream and snacks.

The essential characteristics of the products are presented in-store.
The Customer is required to review them before making any purchase.

  1. Prices
    Prices are indicated in euros, all taxes included (TTC).
    The Seller reserves the right to modify prices at any time, it being understood that the applicable price is the one in force at the time of purchase.
    No discounts or reductions are granted except those expressly announced as part of promotional operations.
  2. Order and payment
    The sale is deemed concluded after:
  • selection of the product by the Customer,
  • acceptance of the price,
  • full payment of the product.

Accepted payment methods are:

  • bank card,
  • cash,
  • any other method accepted in-store.

The Seller reserves the right to refuse a sale in the event of a prior dispute with the Customer or abnormal behavior.

  1. Collection and transfer of ownership
    Products are handed over to the Customer immediately after payment.
    Ownership of the products is transferred to the Customer upon full payment of the price.
    Transfer of risk (loss, theft, damage) occurs upon delivery of the product to the Customer.
  2. Right of withdrawal
    In accordance with Article L221-18 of the French Consumer Code, the right of withdrawal does not apply to purchases made in a physical store.
    However, on a commercial basis and without legal obligation, Instant Outdoor may accept an exchange or store credit subject to:
  • presentation of the receipt,
  • product being new, unused, and in its original packaging,
  • request made within 14 days of purchase.

The following products are excluded from any exchange or store credit:

  • food products (drinks, ice cream, snacks),
  • underwear and items worn directly on the skin,
  • discounted or promotional products,
  • personalized or specific products.

No cash refunds will be issued.

  1. Legal warranties
    Products sold benefit from the legal warranties provided by the French Consumer Code:
  • legal warranty of conformity (Articles L217-3 et seq.),
  • warranty against hidden defects (Articles 1641 et seq. of the Civil Code).

These warranties do not cover:

  • normal wear and tear,
  • damage resulting from improper use,
  • failure to follow the manufacturer’s instructions,
  • modifications or repairs carried out by the Customer or an unauthorized third party.
  1. Use of products
    The Customer undertakes to use the products in accordance with their intended purpose and the manufacturer’s recommendations.
    Instant Outdoor shall not be held liable for bodily injury or material damage resulting from improper, dangerous, or non-compliant use of the products sold.
  2. Liability
    The Seller shall not be held liable in the event of:
  • improper use of the products,
  • failure to follow safety instructions,
  • participation in high-risk sports without appropriate skill level or equipment.

In all cases, the Seller’s liability is limited to the amount of the product concerned.

  1. Food products
    Food products (drinks, ice cream, snacks) are sold in compliance with applicable health standards.
    Any complaint must be made immediately after purchase.
    No returns or exchanges will be accepted for these products after they have been handed over to the Customer.
  2. Personal data
    Personal data collected during the sale are used solely for commercial and accounting management purposes.
    In accordance with applicable regulations, the Customer has the right to access, rectify, and delete their data.
  3. Applicable law and disputes
    These GTC are governed by French law.
    In the event of a dispute, the Customer is invited to contact the Seller in order to seek an amicable solution.
    Failing an amicable agreement, the dispute may be brought before the competent courts in accordance with applicable law.
